Spring Family Session Terms

These terms apply to the Spring Family Sessions at Wollongong Botanic Garden booked for 17–18 or 24–25 October 2026. Your booking confirmation supplies your particular date and time. Together, these terms, your confirmed booking details and any later changes we agree in writing make up your booking agreement. The confirmed booking details govern the time and any expressly agreed variation to your session; these terms govern everything else. Our general website Terms and Conditions are a summary, not an additional booking agreement. The standard Family Photography Agreement does not apply unless separately presented and accepted; if it is, these Spring terms govern the campaign’s price, inclusions, timing, transfers, cancellation and refunds.
Nothing in these terms excludes, restricts or modifies your rights under the Australian Consumer Law or any other right that cannot lawfully be excluded. Our Privacy Policy at watercloudimages.com/privacy-policy explains how we handle personal information.
1. Your session and booking
1.1 The $225 price, including GST, covers one 20-minute session for one family group of up to six people, including children and babies, in a prepared area of Wollongong Botanic Garden. A grandparent or another relative may be included within the six. Please contact us before booking if you want more than six people or several separate family groups; a longer family session may be more suitable.
1.2 Your session includes a curated private online gallery and your selection of ten professionally edited digital photographs from that gallery. Additional edited photographs may be purchased for $35 each, including GST. You may instead unlock all remaining edited gallery photographs for $150, including GST. There is no obligation to buy anything more.
1.3 Full payment of $225 is required at online checkout. Your place is confirmed when you have completed the checkout after being shown these terms, we have received payment, and you have received the booking confirmation. Starting checkout does not reserve a time. No separate retainer or later balance is due for the included session.
1.4 We will provide a short preparation guide and questionnaire after booking. Please tell us in advance about mobility or other access needs, anything that could affect the session, and the names and ages of participating children where requested. You remain responsible for supervising children throughout the session and for ensuring each child has a parent or guardian’s permission to be photographed.
2. Arrival, location and safety
2.1 Please arrive 10–15 minutes before your booked start time. We will send the meeting point and arrival information before your session. The 20-minute session starts at its booked time and normally finishes at its booked finish time if you arrive late. If you arrive 15 minutes or more after the start, we may be unable to photograph you; clause 4 then applies. If we are delayed, we will provide the full 20 minutes or agree another suitable remedy with you.
2.2 Please follow the Garden’s rules and our reasonable safety directions. Pets cannot join a session at the Garden. Accredited assistance dogs accompanying a visitor with a disability are permitted. Please tell us beforehand if you plan to bring an assistance dog so we can plan the location.
2.3 We arrange any permission needed for us to run these sessions at the Garden. If the planned area becomes unavailable or unsafe, we will discuss a suitable nearby area or another reasonable arrangement with you. We may pause or stop photographing if conditions become unsafe, unlawful or threatening; we will discuss an appropriate adjustment or remedy in the circumstances, without limiting your legal rights.
3. Weather and changes we need to make
3.1 Light cloud and overcast conditions are suitable for photography. If the forecast indicates unsuitable or unsafe weather, we will contact you by email and text by 5 pm on the preceding day with our decision to proceed or postpone. Conditions can change overnight; if necessary, we will update you again as soon as practicable on the session day. We may reasonably adjust the meeting point or running order and will tell you promptly.
3.2 If we postpone because of weather or cannot provide the session because of illness, emergency, venue unavailability or another disruption, we will offer a reasonable available replacement time. A change we initiate does not use your one client-requested transfer under clause 4. If we cannot provide a reasonable replacement, you may choose a full refund of the $225 session price. Any additional remedy available under law still applies.
3.3 If we confirm that the session will proceed and you independently decide not to attend, clause 4 applies. We will consider any genuine illness or emergency individually.
4. Changes or cancellation requested by you
4.1 Please email us as early as possible if you need to cancel or move your session. Notice is measured from the scheduled start time. If you give at least seven full days’ notice, you may choose a full refund of the $225 session price or one transfer to an available 2026 Spring Family Session time at no additional charge.
4.2 With less than seven full days’ notice, you may ask for one transfer to an available campaign time. We will consider the request reasonably, including a sudden illness or emergency, but cannot guarantee another place. If you cancel instead and another client books and pays for your original time, we will refund the $225 session price in full.
4.3 If a late-cancelled time cannot be refilled, or if you do not attend, we may retain only an amount that reasonably reflects our work and loss from that booking, taking account of expenses avoided and any replacement booking. Any remainder is refunded. The amount retained cannot exceed the $225 paid for the session. We will explain the amount if you ask.
4.4 One client-requested transfer is available per booking, subject to the timing and availability above. Any further transfer is at our discretion. If you later cancel a transferred session, the same notice and refund rules apply by reference to its new start time. These arrangements do not limit your rights under applicable law.
5. Your photographs and gallery
5.1 We photograph and edit with reasonable care and skill in the style shown in our portfolio. We choose the photographs in the gallery and cannot guarantee a particular pose, expression or image of each person. RAW files, unedited or unselected images, duplicates and working files are not supplied. Extensive retouching can be quoted separately if you ask for it.
5.2 We will deliver the curated gallery through a private online link within two weeks of the session. You can then select and download your ten included edited digital photographs. If you purchase additional photographs or the remaining edited gallery, those files will also be made available through the gallery. If an unexpected production delay occurs, we will tell you the revised delivery date. We cannot finish a selection that depends on your choices until you make them.
5.3 The gallery will remain available for twelve months from delivery, unless we agree another period in writing. Please aim to choose your photographs within thirty days, and download and back up your final photographs during the gallery period. We do not guarantee storage or retrieval after gallery expiry. Unselected and working files may be deleted after final delivery.
5.4 If technical failure or data loss affects your photographs, we will tell you promptly, take reasonable steps to recover them and discuss an appropriate remedy, which may include a further session where practicable. Your rights under the Australian Consumer Law remain unaffected.
6. Copyright and your use
6.1 We agree that copyright in photographs taken for this domestic family session remains with Water Cloud Images. Copyright is assigned only by a separate written agreement. For work by anyone we engage to photograph the session, we will secure the rights needed to grant the licence below.
6.2 Once delivered and paid for, each of your ten selected photographs, and any additional photographs you purchase, carries a non-exclusive, perpetual, non-transferable licence for personal and family use. You may download, store, print, display and share them with family and friends and post them to personal social media. A reasonable crop for display is fine.
6.3 Selling the photographs, using them for business, advertising or fundraising, or giving them to a third party for independent commercial use requires our written permission. Please do not materially change them in a way that misrepresents our work, remove supplied credit or watermark information, or use them to train or develop an AI model without our written permission. Credit on personal social posts is appreciated but not required.
7. Our use of your photographs and privacy
7.1 Permission for us to use identifiable photographs in our portfolio, website, social media or advertising is optional and separate from booking. Refusing permission will not affect your price, session or photographs. We will use an identifiable image for those purposes only with written permission from each adult pictured and a parent or guardian of each child pictured, as applicable.
7.2 You may withdraw your permission for future uses by emailing us. We will stop new uses and remove images under our control within a reasonable time where practicable; earlier printed materials or other people’s sharing may not be reversible. We handle personal information in line with our Privacy Policy at watercloudimages.com/privacy-policy.
8. Concerns and contact
8.1 If you have a concern, please email us as soon as practicable so we can investigate and try to resolve it fairly and in good faith. This request does not limit the time or remedies available to you under law.
8.2 Email counts as written notice under these terms. If part of these terms is unenforceable, the rest continues to apply. These terms are governed by the laws of New South Wales.
