Terms & Conditions

These terms apply generally to services provided by Water Cloud Images.

By booking a session, accepting a quote, signing an agreement, paying a retainer, or otherwise engaging Water Cloud Images, you agree to the relevant terms for your booking.

Where a specific booking agreement, quote, or invoice is issued, those documents form part of your booking and apply to the booked service. If there is any inconsistency, the specific booking documents take priority to the extent permitted by law.

Bookings

A booking is confirmed once the required agreement has been accepted, the required retainer has been paid, and the session or wedding date has been confirmed in writing.

Availability is offered on a first-come, first-served basis.

Water Cloud Images reserves the right to decline bookings that conflict with existing commitments, involve unsafe conditions, or cannot be delivered to a professional standard.

Payments

Prices are as listed on the website or provided in writing.

All displayed prices are in Australian dollars and include GST unless stated otherwise.

A retainer is required to secure a booking date and is credited toward the total booking price.

For family, branding and professional portrait sessions, the remaining balance is due before the scheduled session, according to the payment schedule confirmed at booking.

For weddings, the payment schedule will be confirmed in the quote, invoice, and booking agreement.

No images, galleries, albums, printed products, or final deliverables will be released until full payment has been received.

Cancellations and rescheduling

Rescheduling requests should be made as early as possible and are subject to availability.

For family, branding and professional portrait sessions, one reschedule may be arranged with at least 48 hours’ notice. Unless otherwise agreed, the replacement session must take place within six months of the original date. Sudden illness, unsafe weather, emergencies and other reasonable circumstances will be considered.

For cancellations made more than 14 days before the session, amounts paid will be refunded, less any approved non-recoverable third-party costs or separately agreed pre-production work already completed.

For cancellations made between 14 days and more than 48 hours before the session, the booking retainer will be retained and any remaining amount paid will be refunded.

Cancellations made within 48 hours of the session, additional rescheduling requests or failure to attend will be handled in accordance with the applicable photography agreement and may incur charges reflecting work completed, expenses incurred and the session time reserved.

Wedding date changes, postponements and cancellations are handled in accordance with the wedding photography agreement.

If Water Cloud Images is unable to attend because of illness, emergency, severe weather or circumstances beyond reasonable control, reasonable efforts will be made to reschedule the service or, where appropriate, arrange a replacement photographer of comparable professional standard. If neither option is reasonably possible, amounts paid for services that cannot be provided will be refunded.

Style and editing

By booking, you acknowledge that you are familiar with the photographic style shown on this website.

All images are edited in Water Cloud Images’ established photographic style.

Unedited or RAW images are not provided.

Additional editing requests outside the normal style may incur an extra fee.

Use of images

Water Cloud Images retains copyright in all photographs unless ownership is expressly transferred in writing.

Wedding and family photography

Clients booking wedding or family photography receive a personal-use licence. This allows photographs to be:

  • printed for personal use

  • shared with family and friends

  • posted on personal social media

Photographs may not be sold, supplied to third parties for commercial use or used for any commercial purpose without written permission.

Branding and professional portrait photography

Clients booking branding or professional portrait photography receive a standard business-use licence covering use across their own:

  • website

  • organic social media

  • LinkedIn

  • Google Business Profile

  • email marketing

  • professional profiles

  • self-promotional materials

Paid advertising, third-party publication, franchise use, resale, packaging, signage, billboards and large-scale campaigns require an extended commercial licence, quoted according to the intended use.

Unless a written privacy request is made before or at the time of booking, Water Cloud Images may use selected photographs across its portfolio, website, social media and promotional materials.

All privacy requests will be respected.

Delivery of images

Delivery timeframes vary by service and collection and will be confirmed at the time of booking.

Images are delivered through an online gallery unless otherwise agreed.

Clients are responsible for downloading and backing up their images after delivery.

Locations and third-party conditions

Water Cloud Images is not responsible for restrictions, cancellations, delays, access limitations, permit requirements, or site-specific rules imposed by venues, councils, weather, or third parties.

If a location becomes unavailable or unsuitable, a reasonable alternative will be arranged where possible.

Liability

Water Cloud Images takes reasonable care to provide services as described.

To the extent permitted by law, Water Cloud Images is not responsible for circumstances beyond reasonable control, including but not limited to weather conditions, illness or injury, venue restrictions, travel delays, equipment failure, emergencies, or unforeseen events.

In the unlikely event of technical failure, loss of data, or other circumstances preventing delivery of images, liability is limited to the amount paid for the affected service, except where a different remedy is required by Australian Consumer Law.

Nothing in these terms limits any rights you may have under Australian Consumer Law.

Privacy

Personal information is handled in accordance with the Privacy Policy published on this website.

Disputes

If a concern arises, both parties agree to first attempt to resolve the matter directly and in good faith before seeking formal dispute resolution.

These terms are governed by the laws of New South Wales, Australia.
